Backups

Insly(Pty)Ltd provides regular backups of data for disaster recovery purposes. However, the Customer is responsible for their own backups and should not rely solely on Insly(Pty)Ltd ‘s backups.

Acceptable Use Policy

General and Acceptable Use

The Customer agrees to use the services provided by Insly(Pty)Ltd only for lawful purposes. The Customer must not use the services in a manner that violates any applicable laws or regulations.

Unacceptable Use

The following activities are strictly prohibited and may result in the suspension or termination of services:

  • Use of the services for any illegal activities
  • Transmission of any material that is offensive, abusive, or defamatory
  • Use of the services to distribute malware, viruses, or other harmful software
  • Use of the services for spamming or phishing activities
Interpretation

Insly(Pty)Ltd reserves the right to interpret the terms and conditions outlined in this agreement at its sole discretion.

System and Network Security

The Customer must not attempt to interfere with the security of Insly(Pty)Ltd ‘s systems or networks. Any attempt to do so may result in the suspension or termination of services.

Spamming

The Customer must not use the services to send unsolicited bulk email, or engage in any other form of spamming. This includes the use of purchased or rented mailing lists.

Determination of a Breach of This Policy

Insly(Pty)Ltd reserves the right to determine whether the Customer has breached this policy. Insly(Pty)Ltd ‘s determination shall be final and binding.

Consequences of Breach of This Policy If the Customer breaches this policy, Insly(Pty)Ltd may suspend or terminate the Customer’s services immediately, without notice. The Customer may also be held liable for any damages resulting from their breach.

Modification

Insly(Pty)Ltd reserves the right to modify these terms and conditions at any time, without notice.

Reporting Network Abuse

If the Customer becomes aware of any network abuse, they should report it immediately to Insly(Pty)Ltd ‘s abuse department.

Disclaimers and Limitation of Liability

Insly(Pty)Ltd provides the services “as is” and without warranty of any kind, express or implied. Insly(Pty)Ltd is not liable for any damages, including but not limited to direct, indirect, incidental, or consequential damages, arising from the use of our services.

Responsibility for Content and Account Holder Indemnities

The Customer is responsible for any content posted or transmitted through their website hosted by Insly(Pty)Ltd . The Customer agrees to indemnify and hold Insly(Pty)Ltd harmless from any claims, damages, or expenses arising from their use of our services.

Variation of Services

Insly(Pty)Ltd reserves the right to vary the services provided to the Customer at any time, without notice.

Non-transferability of Services

The Customer may not transfer their services to another party without the prior written consent of Insly(Pty)Ltd .

Passwords

The Customer is responsible for maintaining the confidentiality of their passwords and account information.

Assignment of IP Addresses

Insly(Pty)Ltd may assign IP addresses to the Customer as necessary for the provision of services.

General Provisions

This agreement shall be governed by the laws of South Africa. Any dispute arising from this agreement shall be resolved in accordance with the dispute resolution procedure outlined in this agreement.

Billing Terms of Insly(Pty)Ltd .

General

The Customer agrees to pay all fees associated with the services provided by Insly(Pty)Ltd .

Effect of Non-payment

Failure to pay fees may result in the suspension or termination of services.

Domain Rescue Fees

If a domain is suspended due to non-payment, a domain rescue fee will apply to reactivate the domain.

Payment Methods and Fees

Insly(Pty)Ltd accepts payment by credit card(Payfast), bank transfer, or PayPal. Fees may apply to certain payment methods.

Refunds

Refunds are available within 30 days of service activation. Refunds will not be issued for domains, SSL certificates, or any other non-refundable services.

Cancellations

The Customer may cancel their services at any time. Cancellation requests must be submitted through the customer portal.

Downgrades

The Customer may request a downgrade of their services at any time. Downgrades will be effective at the end of the current billing cycle.

Dispute Resolution

General Dispute Resolution

Any dispute arising from this agreement shall be resolved in accordance with the dispute resolution procedure outlined in this agreement.

Referral of Complaints to ICASA

Complaints may be referred to the Independent Communications Authority of South Africa (ICASA) if the dispute cannot be resolved through our internal dispute resolution procedure.

Billing Dispute Resolution
Purpose of this Procedure

This procedure outlines the process for resolving billing disputes between Insly(Pty)Ltd and the Customer.

Customer’s Obligations to first use this Procedure

The Customer must first attempt to resolve any billing disputes with Insly(Pty)Ltd ‘s billing department.

Time period within which Billing Disputes can be initiated

Billing disputes must be initiated within 60 days of the billing date.

Circumstances under which payment of a Disputed Amount may be withheld

If the Customer disputes a charge, they may withhold payment of the disputed amount until the dispute is resolved.

Billing Dispute Notice

The Customer must provide written notice of the billing dispute to Insly(Pty)Ltd ‘s billing department.

Response to Billing Dispute Notice

Insly(Pty)Ltd ‘s billing department will respond to the billing dispute notice within 30 days.

Referral to Senior Management

If the billing dispute is not resolved to the Customer’s satisfaction, they may escalate the dispute to senior management.

Resolution, Agreement or Determination

The billing dispute will be resolved by agreement, determination, or arbitration.

Effect of this Procedure on continued service provision

The Customer’s services will not be affected during the billing dispute resolution process.

Confidentiality

All information related to the billing dispute will be kept confidential.

Overage Disputes

If the Customer disputes an overage charge, they must provide evidence that the overage was caused by an error on Insly(Pty)Ltd ‘s part.

Request for Reconciliation or Historical Information/Reporting

The Customer may request reconciliation or historical information/reporting regarding their account at any time.

Referral of Billing Disputes to ICASA

If the billing dispute cannot be resolved through our internal dispute resolution procedure, the Customer may refer the dispute to ICASA.

Use of Account Holder information

Insly(Pty)Ltd may use the account holder information for marketing purposes. The account holder may opt-out of marketing communications at any time.

Domain Registration Agreement

The registration of a domain name through Insly(Pty)Ltd is subject to the terms and conditions of the applicable domain registrar. The Customer is responsible for familiarizing themselves with the terms and conditions of the domain registrar.

Introduction

InslyHost is committed to providing high-quality services to our customers. As such, we have established this code of conduct to outline our expectations of our customers and their use of our services, as well as to comply with the regulations set forth by the Independent Communications Authority of South Africa (ICASA).

Storage

The Customer is responsible for ensuring that they have adequate storage space for their website and related files. InslyHost reserves the right to limit or suspend the Customer’s account if they exceed their allocated storage space.

Key Commitments

The Customer agrees to comply with all applicable laws and regulations, including those set forth by ICASA. The Customer agrees to use the services provided by InslyHost only for lawful purposes and in accordance with this code of conduct.

Consumer Rights

InslyHost is committed to protecting the rights of our customers. We will take all reasonable steps to ensure that our services are of a high standard and are fit for their intended purpose. We will also comply with all applicable consumer protection laws, including those set forth by ICASA.

Availability of Information

InslyHost is committed to providing our customers with accurate and up-to-date information regarding our services. We will make every effort to ensure that this information is readily available and easily accessible, in compliance with ICASA regulations.

Vetting of Applications and Use of registered Credit Bureaus

InslyHost reserves the right to vet all applications for our services. We may also use registered credit bureaus to assess the creditworthiness of our customers, in compliance with ICASA regulations.

Written Terms and Conditions of Service

All customers of InslyHost will be provided with written terms and conditions of service, in compliance with ICASA regulations. These terms and conditions will outline the rights and responsibilities of both InslyHost and the Customer.

Minimum Standards for the Services offered by InslyHost(Pty)Ltd

InslyHost is committed to providing high-quality services to our customers, in compliance with ICASA regulations. We have established minimum standards for our services to ensure that they are of a high standard and are fit for their intended purpose.

Miscellaneous

InslyHost reserves the right to amend or modify this code of conduct at any time, in compliance with ICASA regulations. The Customer agrees to be bound by any changes to this code of conduct. If the Customer breaches any provision of this code of conduct, InslyHost may take appropriate action, including limiting or suspending the Customer’s account, terminating the Customer’s account, or taking legal action against the Customer, in compliance with ICASA regulations. This code of conduct shall be governed by and construed in accordance with the laws of South Africa. Any dispute arising from this code of conduct shall be resolved in accordance with the dispute resolution procedure outlined in the written terms and conditions of service, in compliance with ICASA regulations.
